1. Introduction & Agreement

These Terms and Conditions  govern your use of our website Lusitano Home Remodeling, if you have one and the home remodeling, renovation, and related services like kitchen remodeling, bathroom remodeling, flooring, epoxy floors, tiles services, painting, mold remedation we offer. By engaging our Services or using our website, you (“Client,” “you,” “your”) agree to be bound by these Terms. If you do not agree, please do not use our Services or website. These Terms, along with any signed Proposal, Estimate, or Contract, form the complete agreement between you and Lustiano Home Remodeling.

2. Services
Lustiano Home Remodeling offers a range of home remodeling services, which may include, but are not limited to:

  • Dry Wall

  • Flooring

  • Epoxy Floors

  • Painting

  • Tiles Services

  • Mold Remedation

The specific scope of work, materials, timeline, and costs for your project will be detailed in a separate written Proposal or Contract provided to you for review and signature.

3. Estimates, Proposals, and Contracts

  • Estimates/Proposals: We will provide a detailed written estimate or proposal based on an initial consultation and assessment of the project scope. Estimates are based on the information available at the time and may be subject to change if unforeseen conditions arise or the scope of work changes.

  • Contract: A formal Contract detailing the final scope of work, materials, project schedule, payment terms, warranties, and incorporating these Terms and Conditions must be signed by both parties before work commences. The signed Contract supersedes any prior discussions or estimates.

4. Project Process

  • Consultation & Design: Initial discussion and potential site visit to understand your needs and project scope.

  • Proposal & Contract: Presentation of the detailed plan, cost breakdown, and contract for your approval.

  • Permits: We will typically handle obtaining necessary building permits, the cost of which may be included in the contract or billed separately, as specified. You agree to cooperate in providing necessary information or access for permit applications.

  • Scheduling & Execution: Work will be scheduled upon contract signing and receipt of any required deposit. We will perform the work professionally and in accordance with industry standards and applicable building codes.

  • Change Orders: Any changes to the agreed-upon scope of work must be documented in a written Change Order, signed by both parties, detailing the changes, any cost adjustments, and potential impact on the schedule.

  • Completion & Walkthrough: Upon substantial completion, we will conduct a final walkthrough with you to ensure the work meets the contract requirements and address any agreed-upon punch list items.

5. Pricing and Payment

  • Contract Price: The total price for the project will be stated in the signed Contract.

  • Payment Schedule: Payments are typically due in installments as outlined in the Contract (e.g., deposit upon signing, progress payments at specific milestones, final payment upon completion).

  • Late Payments: Payments not received by the due date may incur late fees as specified in the Contract or allowed by law. We reserve the right to suspend work if payments are significantly overdue.

6. Client Responsibilities

  • Access: Provide clear and safe access to the work site during agreed-upon working hours.

  • Preparation: Prepare the work area as requested (e.g., removing personal belongings, securing pets).

  • Decisions: Make timely decisions regarding materials, finishes, and approvals to avoid project delays.

  • Utilities: Ensure necessary utilities (water, electricity) are available at the site.

  • Communication: Communicate any concerns or questions promptly to the designated project manager or contact person.

  • HOA Approval: Obtain any necessary approvals from your Homeowners Association (HOA), if applicable, prior to work commencement.

7. Warranty

  • This warranty covers defects directly caused by faulty installation or workmanship performed by us or our direct subcontractors.

  • Warranty claims must be submitted in writing. We reserve the right to inspect the issue and determine the appropriate remedy (repair or replacement at our discretion).

8. Insurance and Liability

  • Our Insurance: Lustiano Home Remodeling maintains appropriate General Liability insurance and Workers’ Compensation insurance (if applicable). Proof of insurance can be provided upon request.

  • Limitation of Liability: Our total liability for any claims arising out of or related to the project or our Services shall not exceed the total amount paid by you under the relevant Contract. We are not liable for indirect, incidental, special, or consequential damages (e.g., loss of use, lost profits). We are not responsible for damage to areas outside the defined scope of work unless caused directly by our negligence.

9. Subcontractors
We may utilize qualified and insured subcontractors for specialized portions of the work (e.g., electrical, plumbing). We remain responsible for the overall project management and the quality of work performed by our subcontractors as part of our scope.

  • You agree to use our website only for lawful purposes.
